The French competition authority, known as the Autorité, has provided two significant opinions in response to requests from the government concerning reforms in the electricity sector. These opinions focus on the new capacity mechanism and the universal nuclear payment (VNU), both of which are set to replace the existing ARENH mechanism.
The first opinion, issued on September 26, 2025, addresses a draft decree for a new capacity mechanism aimed at ensuring electricity supply security during peak winter periods. The Autorité notes that while the mechanism serves its primary purpose, its structural changes could impact costs for end-consumers, as suppliers may pass on costs without incentivizing reduced consumption during peak times. The Autorité emphasizes the need for monitoring the role of the French electricity transmission system operator, RTE, and the regulatory oversight by the French energy regulator, CRE.
The second opinion, released on November 27, 2025, discusses the VNU, which is designed to protect consumers from price volatility while allowing EDF to finance future investments. The Autorité highlights that the VNU is less protective than the ARENH and raises concerns about its implementation period, which does not cover winter consumption. Recommendations include clarifying the VNU's objectives and conducting a review after three years to assess its impact on consumers and suppliers.
