The Hungarian competition authority, known as the Gazdasági Versenyhivatal (GVH), has imposed a fine of 111 million Hungarian Forints on DIGI Távközlési és Szolgáltató Kft. for failing to clearly communicate changes in subscriber fees effective from January 1, 2023, and subsequent inflation-related adjustments starting in May 2023.
The investigation began in the autumn of 2023 after the GVH received multiple complaints about DIGI's inconsistent and contradictory communication practices regarding these fee changes. The authority found that DIGI did not adhere to the required professional diligence when informing consumers about the fee increases.
In November 2022, DIGI informed consumers about both the fee increase and the new inflation-adjusted fee correction, which would take effect simultaneously on January 1, 2023. However, the communication was unclear, leading subscribers to believe that both fee increases were protected by their loyalty period, despite the fact that the fee correction would apply during this period as well.
During the proceedings, DIGI cooperated with the GVH, acknowledged the violation, and waived its right to appeal. As a result, the GVH's Competition Council mandated the company to fulfill its commitment to compensate affected consumers by crediting the additional fees charged during the loyalty period to new subscribers who were under contract during the relevant period.
