The Netherlands Authority for Consumers and Markets (ACM) has issued a directive to energy suppliers prohibiting the use of telemarketers that falsely represent themselves as independent energy comparison service providers. This measure aims to protect consumers from misleading sales practices in the energy sector.

ACM's ongoing investigation into telemarketing practices revealed that many telemarketers mislead consumers by posing as independent advisors. However, these telemarketers are incentivized by commissions from energy suppliers, which compromises the integrity of their comparisons. Consequently, consumers may end up with energy contracts that do not suit their needs.

In a letter to energy suppliers, ACM has requested that they outline the steps they will take to ensure compliance with these regulations. The authority has reiterated that the responsibility for the sales process lies with the energy suppliers, who must ensure that any third-party businesses selling contracts on their behalf adhere to the rules.

ACM has previously warned about the risks associated with telemarketing in the energy sector, highlighting that energy contracts are complex and should not be agreed upon over unsolicited phone calls. Consumers are advised to take their time when considering offers and to compare them with their current contracts and other providers to avoid potential pitfalls.
