CNMC Takes Action Against Factor Energía for Deceptive Practices

The Spanish competition authority has imposed measures on Factor Energía to prevent fraudulent electricity and gas contracting practices affecting consumers.

The Spanish competition authority, CNMC, has imposed measures on Factor Energía, S.A. to protect consumers from deceptive commercial practices in the electricity and gas sectors. Despite holding only a 1% market share, Factor Energía accounted for 61% of complaints regarding misleading practices from January 2023 to August 2025.

The measures aim to ensure that consumers are fully informed during the contracting process, including clear identification of the calling company and the purpose of the call. Additionally, the company must obtain explicit consent from consumers before making commercial calls.

Factor Energía is also required to enhance the information provided during the contracting process and to regularly report key performance indicators to the CNMC to monitor compliance. Failure to adhere to these measures could result in serious legal infractions under sectoral legislation.
