FTC Takes Action Against Companies Misleading Consumers with False 'Made in the USA' Claims

The Federal Trade Commission has announced enforcement actions against three companies for falsely advertising their products as 'Made in the USA', following a directive from President Trump to ensure truthful advertising.

The Federal Trade Commission (FTC) has initiated law enforcement actions against three companies for misleading consumers by falsely claiming that their products were made in the United States. This initiative aligns with President Trump’s Executive Order aimed at ensuring truthful advertising of products claiming to be made in America.

The companies involved include TouchTunes Music Company, Americana Liberty LLC, and Oak Street Manufacturing Company. Each company is accused of making unqualified and unsubstantiated 'Made in the USA' claims in their advertising and labeling, despite using imported components in their products.

TouchTunes, for instance, falsely advertised its electronic dartboards as American-made, even though essential components were sourced from abroad. The FTC's complaint led to a settlement requiring TouchTunes to pay $625,000 in consumer redress and to cease misleading claims.

Americana Liberty and its affiliates were similarly charged for falsely labeling patriotic flags and related products as American-made, despite many being imported from China. They agreed to a settlement of $167,743 and are prohibited from making misleading country-of-origin claims.

Oak Street Manufacturing faced allegations for claiming its footwear products were entirely made in the U.S. while actually sourcing parts from the Dominican Republic and Brazil. The company will pay $75,000 in consumer redress and must stop making false U.S.-origin claims.

In addition to these actions, the FTC issued closing letters to two other companies that had been under investigation for similar misleading claims, allowing them to remediate their practices while warning of potential future actions.
