ACCC Seeks Feedback on Authorisation for Organic Waste Biorefinery Development

The Australian Competition and Consumer Commission has proposed to authorise Sydney Water and several councils to jointly develop an organic waste biorefinery, allowing for collective negotiations with a chosen developer.

The Australian Competition and Consumer Commission (ACCC) has issued a draft determination proposing to authorise Sydney Water Corporation along with Campbelltown City Council, Wingecarribee Shire Council, and Wollondilly Shire Council to collaborate on the development of an organic waste biorefinery.

The proposed authorisation would allow the Applicants to jointly evaluate responses to a request for proposal for the biorefinery, negotiate long-term supply agreements with the selected developer, and implement those agreements. The ACCC has indicated that this authorisation would be valid until 31 December 2052.

To facilitate the process, the ACCC has granted interim authorisation, enabling the Applicants to begin evaluating proposals and negotiating agreements, although they are not yet permitted to finalize or implement these agreements.

The ACCC is currently inviting submissions regarding the draft determination, with a deadline set for Wednesday, 21 January 2026, before making a final decision on the matter. More information about the application and submission process can be found on the ACCC's public register.
