The Polish competition authority, UOKiK, has raised concerns regarding L’Oréal Polska's environmental communication related to its Garnier cosmetics. The company used a 'Green Product Impact Labelling' system that rated products from A to E, suggesting a clear environmental impact. However, consumers were not informed that these ratings were based solely on comparisons within L’Oréal's product range, rather than against a broader market.
UOKiK President Tomasz Chróstny emphasized that such misleading information could constitute greenwashing, where products are presented as more environmentally friendly than they truly are. The authority's investigation revealed that the ratings did not meet objective environmental criteria, potentially leading consumers to believe that higher ratings indicated a genuinely lower environmental impact.
In addition to the case against L’Oréal, UOKiK is also addressing similar issues in a court case involving Nestlé Polska and its Nałęczowianka water brand. The authority's stance is that marketing claims must be clear and truthful to avoid misleading consumers about environmental benefits.
