In a recent speech to the Senate Standing Committee on Social Affairs, Science and Technology, Brad Callaghan, Associate Deputy Commissioner of the Competition Bureau, highlighted the critical role of data portability and interoperability in enhancing competition in Canada's digital health care sector.

The Bureau, an independent agency enforcing Canada's Competition Act, has been advocating for data portability as a means to stimulate competition, innovation, and better services for consumers. Callaghan noted that the ability to easily transfer data can save consumers time and money, making it essential for a competitive market.

However, data transfer alone is insufficient; interoperability between digital systems is necessary for meaningful competition. The Bureau's 2022 Digital Health Care Market Study revealed that most health care providers rely on a few dominant electronic medical record (EMR) systems, which can hinder access to personal health information.

To address these challenges, the Bureau made three key recommendations: harmonizing privacy and data governance rules, enforcing anti-blocking rules for EMR companies, and establishing interoperability standards for EMR systems. These measures aim to facilitate easier switching between providers and encourage new entrants into the market.

Callaghan expressed support for Bill S-5, which aligns with the Bureau's recommendations and represents a step forward in promoting interoperability and compliance in the health care sector. He concluded by noting the Bureau's commitment to conducting investigations privately while protecting the confidentiality of information.
