The Portuguese Competition Authority (AdC) has launched an investigation into a business association for allegedly setting minimum prices in the tourism sector, resulting in a formal Statement of Objections. This investigation began in June 2024 and uncovered evidence that the association had been involved in price-fixing practices since at least 2020.

The AdC's findings indicated that the business association recommended specific prices in fee schedules and established minimum percentage increases for prices charged by its member companies and other service providers. Such actions are considered serious infringements of competition law, as they undermine the autonomy of businesses in determining their pricing strategies.

Upon issuing the Statement of Objections, the AdC has provided the association with a reasonable timeframe to respond and defend itself against the allegations. This process allows the association to address the evidence collected and the potential sanctions it may face. Following the conclusion of the investigation and the exercise of the rights of defense, the AdC will issue a final decision on the matter.

The AdC emphasizes that business associations must avoid engaging in price-setting practices, as these actions harm consumers and diminish competition within the market. To promote compliance, the AdC has released a Guide for Business Associations, which outlines prohibited conduct and the advantages of maintaining competitive practices. This investigation is part of the AdC's broader strategy to combat anti-competitive behavior and enhance engagement with the business community and public authorities across Portugal.
