The Autorité de la concurrence has released an updated procedural notice on its leniency programme, replacing the previous notice from 2015. The new notice reflects changes brought about by the ECN+ Directive, the DDADUE Law, and Decree 2021-568. It clarifies the eligibility conditions for immunity, introduces the use of markers to secure a place in the leniency queue, and outlines the guarantees provided to leniency beneficiaries. The notice also modernizes the application process by allowing for electronic submissions. This update, along with the recent introduction of whistleblower reporting procedures, strengthens the Autorité's ability to detect anticompetitive practices.
