The Lithuanian Competition Council has determined that Saisto projektai and Modulasoft engaged in bid coordination during a public procurement procedure for artificial intelligence consultancy services organized by the Alytus City Polyclinic. This action constitutes a breach of the Law on Competition.

In June 2025, the Alytus City Polyclinic initiated a public procurement process where both companies participated. Saisto projektai was initially declared the winner but failed to sign the contract, which was then awarded to Modulasoft, the second-ranked bidder.

Following a request from the Alytus City Polyclinic, the Competition Council launched an investigation and found that the two companies had prepared their bids for each other, submitted them from the same computer, and predetermined the winner of the tender.

The investigation revealed that their actions constituted a violation of competition law, which prohibits agreements that restrict competition, including bid coordination in public procurement. Jolanta Ivanauskienė, Chairwoman of the Competition Council, emphasized that such collusion undermines the purpose of public procurement and harms taxpayers.

As both companies admitted to the infringement, their fines were reduced by 15%. Modulasoft, which cooperated with the investigation, received an additional 30% reduction. Saisto projektai was fined EUR 580, while Modulasoft faced a fine of EUR 9,180.

The decision can be appealed to the Regional Administrative Court within one month. The Competition Council encourages contracting authorities to report any suspicions of collusion among suppliers.
