The Danish competition authority, known as Konkurrence- og Forbrugerstyrelsen, has ruled that Øresundslinjen Helsingør ApS has breached a commitment made to the authority regarding ticket resale on the ferry route between Helsingør and Helsingborg. This commitment, originally made by Scandlines Danmark A/S in 2010, prohibited the company from preventing the resale of tickets, which was deemed necessary to ensure fair competition among freight customers.
According to the authority, Øresundslinjen has engaged in practices that discouraged ticket resale from December 3, 2015, to January 4, 2023. These practices included encouraging freight customers to stop reselling tickets, worsening conditions for those who did resell, and improving conditions for those who ceased resale activities. Such actions were seen as attempts to limit competition and maintain an unfair advantage for larger freight customers who typically receive better discounts on tickets.
The authority emphasized that Øresundslinjen is bound by the commitments made by Scandlines, as it currently operates the ferry route in question. The original prohibition against ticket resale was established to address competitive concerns, as smaller freight customers struggled to compete with larger ones due to unequal access to discounts.
In light of these findings, the competition authority plans to take the case to the Maritime and Commercial Court, seeking a civil penalty against Øresundslinjen for its violations of the commitment.
