The Competition Council has decided to change its sanctioning practice for unreported business transactions, shifting from basing fines on the revenue of the acquired company to calculating them based on the total annual worldwide turnover of the infringing undertaking.

This change aims to ensure that fines are more proportionate to the revenues of companies violating competition law, deterring such infringements. Recent investigations in 2023 revealed an increase in unnotified transactions, prompting the need for stricter measures.

Under the Law on Competition, fines for implementing unnotified concentrations can reach up to 10% of the offender's total annual worldwide turnover. The Competition Council will consider various factors when determining fines, such as the duration of the infringement and any aggravating or mitigating circumstances.
