Slovenian Competition Authority Concludes Settlement Process in Automotive Sector

The Slovenian competition authority has finalized a settlement process involving several automotive companies that violated competition laws, leading to reduced administrative sanctions.


The Slovenian Competition Authority, known as Agencija, issued an administrative decision on December 28, 2021, determining that several companies, including RENAULT NISSAN SLOVENIJA and others, violated Article 6 of the ZPOmK-1 and Article 101 of the TFEU. Following this decision, all parties involved, except one that applied for leniency, initiated judicial review proceedings against the authority's ruling.

With the introduction of the new law, ZPOmK-2, in January 2023, the authority has implemented new provisions allowing for a reduction of administrative sanctions by up to 20% based on settlement applications. The Agencija encourages companies to submit settlement applications and leniency statements, which provide certain benefits and contribute to quicker resolution of cases.

Previously, the Agencija had reached settlements with four of the parties involved, and by the end of 2024, it finalized a settlement with the last party. This party actively cooperated with the Agencija throughout the investigation, acknowledged the violation, and withdrew its lawsuit against the authority's decision. Consequently, the Agencija accepted the settlement application and adjusted the administrative sanction accordingly.

With the withdrawal of the last lawsuit against the 2021 decision, the proceedings against all parties have been conclusively resolved.
