Empowering Consumers: New Collective Proceedings in Poland

A new law in Poland allows consumers to collectively pursue claims against businesses, with at least 10 consumers needed to file a lawsuit. The President of the Office of Competition and Consumer Protection (UOKiK) is awaiting authorized entities to register and support these group actions in court.


A new law in Poland has introduced a mechanism for consumers to collectively seek redress against businesses, known as 'representative actions' or 'group proceedings'. This allows at least 10 consumers to file a lawsuit together, with the option for others to join by expressing their consent ('opt-in'). Authorized entities, such as recognized NGOs, can organize and represent the group in legal proceedings.

The new system aims to streamline the process of claiming compensation from unfair businesses. The President of UOKiK is looking for entities to register and assist in bringing group lawsuits to court. These actions can demand specific remedies for consumers, such as refunds, product exchanges, or contract terminations.
