Croatian Court Upholds Ruling Against SPAR for Unfair Trading Practices

The High Administrative Court of Croatia has upheld a ruling against SPAR HRVATSKA, confirming the Croatian Competition Agency's decision on unfair trading practices in food sales.

The High Administrative Court of the Republic of Croatia has dismissed the appeal filed by SPAR HRVATSKA d.o.o., a re-seller, against the Croatian Competition Agency (CCA). This ruling affirms the CCA's decision from July 22, 2021, which found SPAR guilty of imposing unfair trading practices.

The Administrative Court in Zagreb had previously rejected SPAR's claim to annul the CCA's infringement decision. The CCA determined that SPAR sold a specific food product, flour, to consumers at a price lower than any purchase price in the supply chain, including VAT, which constitutes a serious violation of the Unfair Trading Practices (UTPs) Act.

This ruling confirms the legal validity of the CCA's decision, which highlighted that during a specific period in November 2018, SPAR's pricing strategy was in direct violation of Article 12 item 14 of the UTPs Act. The court's decision reinforces the importance of compliance with fair trading regulations in the food industry.
