The European Commission has announced a revised block exemption regulation concerning technology transfer agreements, which will come into force on May 1, 2026. This regulation allows certain agreements between companies regarding technology transfer to be exempt from the prohibition on anti-competitive collaborations, provided they meet specific conditions.

Additionally, the updated guidelines offer clarity on the application of Article 101 of the Treaty on the Functioning of the European Union (TFEU) to technology transfer agreements that do not fall under the block exemption. These guidelines are essential for companies engaged in technology licensing, ensuring compliance with EU competition laws.

The new rules aim to facilitate innovation and collaboration among businesses while maintaining fair competition in the market.
