The Polish competition authority, UOKiK, has imposed a fine of 21,475,000 PLN on the company Nasz Prąd for including 21 unfair clauses in their contracts. These clauses were deemed detrimental to consumers, particularly affecting their rights and financial commitments.
Among the problematic clauses was one that allowed Nasz Prąd to change the power of heat pumps after the contract was signed, leaving consumers uncertain about the product they would receive. This clause shifted the burden of any changes onto the consumers without allowing them to withdraw from the contract.
Another clause allowed the company to impose a daily penalty of 1,000 PLN on consumers if their property was not ready for thermal modernization, potentially exceeding the investment's value. Consumers were not informed about the necessary conditions for their property prior to signing the contract.
Additionally, if consumers failed to pay the remaining price for a pellet boiler or heat pump within 14 days, Nasz Prąd could dismantle the device and charge consumers for installation and dismantling costs, which could exceed the investment value.
UOKiK also found a clause that shifted the responsibility for the structural integrity of the roof onto consumers, which was deemed unacceptable. The authority's decision is not final, as Nasz Prąd has the right to appeal.
UOKiK continues to receive complaints about Nasz Prąd, including issues related to contract signing practices and misleading information provided by sales representatives. The authority has also notified the prosecutor's office regarding potential criminal activities related to these contracts.
