Belgian Competition Authority Fines Companies for Bid Rigging in Newspaper Distribution

The Belgian Competition Authority has imposed fines totaling nearly EUR 12 million on bpost, DPG Media, Mediahuis, and PPP for manipulating the public procurement process for newspaper distribution.

The Belgian Competition Authority (BCA) has held bpost, DPG Media, Mediahuis, and PPP liable for bid rigging in the public procurement procedure for the 2023-2027 newspaper distribution concession. A combined fine of EUR 11,898,483 was imposed on these companies for their collusion to ensure that bpost would be the sole bidder.

The BCA's investigation revealed that the involved parties agreed to prevent PPP from submitting a bid, allowing bpost to dominate the tender process. This manipulation was found to violate both Belgian and European competition laws, specifically the prohibition against anti-competitive agreements.

In a notable first, the BCA also prosecuted and fined two individuals directly involved in the infringement. The companies acknowledged their roles and accepted a settlement proposed by the BCA, which included leniency provisions that reduced their fines based on their cooperation.

bpost received full immunity from fines for revealing the infringement, while DPG Media and Mediahuis received reduced fines of EUR 3,786,574 and EUR 7,788,423, respectively. PPP was fined EUR 323,486. The BCA emphasized the importance of holding individuals accountable for competition violations, alongside the companies they represent.

The BCA continues to prioritize the manipulation of public procurement procedures and is actively working to raise awareness among public buyers about competition distortions. The decision will be published on the BCA's website, and individuals with knowledge of cartel activities are encouraged to report them for potential immunity from fines.
