ACCC Approves Joint Procurement for Organic Waste Bio-Refinery

The Australian Competition and Consumer Commission has authorized Sydney Water and several councils to collaborate on developing an organic waste bio-refinery in southwestern Sydney.

On 4 February 2026, the Australian Competition and Consumer Commission (ACCC) issued a final determination granting authorization to Sydney Water Corporation, Campbelltown City Council, Wingecarribee Shire Council, and Wollondilly Shire Council. This authorization allows them to engage in specific conduct related to the procurement of an organic waste bio-refinery.

The bio-refinery is designed to process food and garden organic waste, as well as wastewater organics. The authorized conduct includes jointly evaluating responses to requests for proposals for the development of the bio-refinery, collectively negotiating non-exclusive, long-term supply agreements with the selected developer, and entering into those agreements.

The ACCC believes that this collaborative approach is likely to yield public benefits that outweigh any potential public detriment. As a result, the ACCC has granted authorization for this conduct until 31 December 2052.
