The Court of Justice has ruled that the FIFA and UEFA rules requiring prior approval for interclub football competitions, such as the Super League, are in violation of EU competition law and the freedom to provide services.

20.12.2023 | Court of Justice of the EU

The Court of Justice has declared that the rules of FIFA and UEFA, which grant them the power to approve interclub football competitions in Europe and control the exploitation of media rights, are contrary to EU law. The court found that these rules restrict competition and violate the freedom to provide services. The judgment also states that FIFA and UEFA abuse their dominant position and that their rules on approval, control, and sanctions are unjustified restrictions. However, the court did not rule specifically on the Super League project. The judgment highlights the potential harm caused by these rules to European football clubs, media companies, consumers, and television viewers. The Commercial Court in Madrid will determine whether these rules may still benefit stakeholders in football.
