CNMC Proposes Measures to Enhance Competition in State Bus Contracts

The Spanish competition authority, CNMC, has recommended a series of measures aimed at improving competition in public bus service contracts.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has analyzed draft documents for public service bus transport contracts requested by the Ministry of Transport and Sustainable Mobility. These contracts will determine how concessions for regular passenger transport by bus are awarded to winning companies.

To promote effective competition and efficient economic regulation, the CNMC suggests several recommendations. These include breaking down contracts into smaller lots to encourage participation and competition, avoiding default ten-year concessions, and justifying the need for a minimum number of vehicles assigned to each contract.

Additionally, the CNMC advises specifying criteria for vehicle age based on objective economic parameters, limiting obligations to personnel directly linked to the concession, and reconsidering financial solvency thresholds. The authority also recommends eliminating criteria based on perceived quality and considering the use of less polluting vehicles.

These recommendations aim to enhance competition in the market and ensure that public funds are allocated efficiently while maintaining service quality for users.
