The Netherlands Authority for Consumers and Markets (ACM) has initiated enforcement action against Park Residence Tergouw located in Oosterhout, due to violations of the Dutch Electricity Act and the Dutch Gas Act.

This action was triggered by complaints from residents regarding the safety and reliability of their electricity and natural gas networks. ACM's investigation revealed that Tergouw's administrative system does not meet statutory requirements, leading to an order with periodic penalty payments of 300,000 euros.

ACM has mandated Tergouw to separate its bookkeeping for natural gas and electricity from other administrative functions to clarify the costs residents incur for these services. Additionally, Tergouw must comply with all other statutory requirements applicable to system operators and energy suppliers.

Residents have reported frequent power disruptions and limitations on using multiple appliances simultaneously due to the network's inadequate capacity. ACM has also received reports of unsafe conditions within the park.

Park Residence Tergouw, a former holiday park now allowing permanent residency, operates its utility networks independently, which were originally built in the 1970s and are not equipped for modern energy demands. ACM's enforcement action aims to address these safety concerns and ensure compliance with regulatory standards.

Tergouw has until March 15, 2026, to comply with the requirements. Failure to do so may result in a fine of up to 900,000 euros. Alternatively, Tergouw can opt to have Liander, the regional distribution system operator, construct a new grid and natural gas network for the park.
