The Comisión Nacional de los Mercados y la Competencia (CNMC) has released its report on the draft Royal Decree regulating the management of waste from wet wipes and balloons, requested by the Ministry for Ecological Transition and Demographic Challenge.

This proposed regulation aims to establish a legal framework to mitigate the environmental impact of these products through efficient waste prevention and treatment measures. It emphasizes extended producer responsibility and improved coordination among various administrative bodies to enhance transparency, effectiveness, and legal certainty.

While the CNMC views the draft positively, it has identified areas for improvement regarding competition promotion and good regulatory principles. Recommendations include justifying the threshold for prevention and eco-design plans, ensuring territorial specifications in producer responsibility systems are justified, and establishing a specific timeline for issuing reports to enhance legal certainty.

The CNMC can act consultatively, being consulted by legislative chambers, the government, and various organizations, or act on its own initiative as per the relevant laws.
