The Lisbon Court of Appeal has upheld the competition infringement by Super Bock, as sanctioned by the AdC, and confirmed the full amount of the 24 million euro fine. The court stated that the fines imposed were proportionate and appropriate, considering the seriousness of the conduct, the size of the affected market, the long duration of the infringement, and the economic situation of Super Bock. The ruling also emphasized the importance of promoting awareness and discouraging future infringements. The case involved Super Bock's vertical agreement with other companies to fix prices, which restricted competition in the beer market and harmed consumer rights. The markets affected include the distribution of beers, waters, soft drinks, iced tea, wines, sangrias, and ciders in hotels, restaurants, and cafés. Super Bock is recognized as one of the largest Portuguese companies in these markets and is of strategic importance for domestic consumption and national exports.
