Lithuanian Competition Council Enhances Oversight of Digital Markets

The Lithuanian Competition Council has begun its supervisory role for online platforms as of January 1, 2025, following new legislation aimed at promoting fairness in digital markets.


As of January 1, 2025, the Lithuanian Competition Council has assumed new supervisory functions under the Law on the Supervision of Online Intermediation Services and Online Search Engines. This law aligns with Regulation (EU) 2019/1150, which aims to ensure fairness and transparency for business users of online intermediation services.

The new regulation provides clear and understandable conditions for companies using online platforms, particularly benefiting small and medium-sized enterprises. It encourages these businesses to leverage online platforms more effectively, thereby enhancing competition in the digital marketplace. Business users can now approach the Competition Council to address grievances, expanding their options beyond the courts.

The Competition Council's responsibilities include monitoring compliance with the new regulation, investigating complaints, and conducting independent investigations into potential infringements. The authority will also collaborate with other EU Member States on cross-border investigations and share information with the European Commission regarding any violations.

In cases of infringement, the Competition Council has the power to mandate the cessation of unlawful practices, enforce compliance with the regulation, and impose fines ranging from EUR 300 to EUR 15,000, depending on various factors such as the severity and duration of the infringement.

To prepare for these new responsibilities, the Competition Council adopted a resolution on Activity Priorities and updated its Rules of Procedure on December 10, 2024. These changes outline the investigation processes for potential infringements and establish reporting requirements for businesses.

The Council will prioritize investigations that significantly protect the rights and interests of business users, considering strategic importance and resource efficiency before proceeding with any inquiries.
