The Bundeskartellamt, Germany's competition authority, has granted approval for Ball Corporation's intended acquisition of 80% of the shares in Benepack Belgium N.V. and Benepack Hungary KFT. This decision was made within a month of the merger notification.
Both companies are engaged in the manufacturing and distribution of beverage cans across Europe. The authority examined the merger's impact on the highly concentrated beverage can markets, analyzing supply flows, market shares, capacities, and the competitive proximity between Ball and Benepack.
Additionally, the authority consulted customers and suppliers regarding their procurement and competitive conditions. The investigation found no significant impediment to effective competition, either through coordinated or non-coordinated effects. There were no indications of a substantial incentive for Ball to raise prices as a result of the merger, nor was there evidence of Benepack possessing significant competitive power. Consequently, the merger was approved.
