The Australian Competition and Consumer Commission (ACCC) has filed Federal Court proceedings against Dusk Australasia Pty Ltd, alleging the company supplied homewares containing button batteries that failed to comply with mandatory safety and information standards, violating the Australian Consumer Law.

Between May 17, 2023, and December 12, 2024, Dusk allegedly supplied 66,453 products across 29 different lines, including candles and LED items, that did not meet safety requirements. These products, often themed for holidays, are particularly attractive to young children, who are at risk of serious injury from button batteries.

ACCC Deputy Chair Catriona Lowe emphasized the importance of compliance with safety standards, noting that button batteries can cause severe harm if ingested. The ACCC claims that 25 of the product lines were not tested for compliance before being sold, and four lines lacked necessary safety warnings, leaving consumers uninformed about the risks.

In April 2023, Dusk had previously accepted a court-enforceable undertaking after supplying non-compliant Halloween-themed products and paid penalties for earlier violations. The ACCC is now seeking declarations, penalties, and orders for Dusk to pay back any financial benefits gained from these alleged breaches.

Following ACCC's intervention, Dusk has ceased supplying the non-compliant products and initiated a recall for certain items. The ACCC continues to prioritize compliance with button battery safety standards to protect consumers, especially children.
