The Federal Trade Commission (FTC) has sent a warning letter to StubHub Holdings, Inc., the largest ticket exchange and resale platform in the U.S., regarding its compliance with the agency's new Fees Rule. This rule mandates that businesses must clearly disclose the total price of live-event tickets, including all mandatory fees, to avoid misleading consumers.
Chris Mufarrige, Director of the FTC’s Bureau of Consumer Protection, emphasized that companies have had ample time to adjust their advertising practices to align with the new regulations. The FTC is committed to ensuring that businesses do not exploit loopholes in the rule for competitive advantage.
According to the Fees Rule, which took effect on May 12, businesses must display the total price of tickets, which includes all fees and charges except for taxes, shipping, and optional items. The FTC's letter highlighted that StubHub had failed to include certain mandatory fees, such as fulfillment and service fees, in the prices displayed on its website.
With the NFL's 2025 season schedule set to be released, the FTC reminded StubHub that each instance of non-compliance could result in civil penalties, potentially amounting to $53,088 per violation. The agency has also provided guidance to assist both consumers and businesses in adhering to the new Fees Rule.
