The Autorité de la concurrence has initiated an ex officio investigation into potential anticompetitive practices in the pay TV sector and the acquisition and broadcast of cinematographic works.

This decision opens a phase where objections may be notified to the companies involved, allowing for a fair investigation respecting their rights of defense.

Article L. 463-6 of the French Commercial Code allows the Autorité to communicate on ex officio proceedings, ensuring transparency while upholding the presumption of innocence of the companies concerned.

Other European competition authorities, such as the European Commission and several national authorities, also utilize similar communication mechanisms.

The Autorité de la concurrence may start proceedings based on referrals from various entities, including the French Minister of Economy, companies, local authorities, and trade unions, or initiate investigations ex officio.
