The Swedish competition authority has updated its prioritization policy, which now includes considerations for initiating reviews under the Public Sales Act (LOS). This policy aims to enhance transparency in how the authority selects cases for investigation, especially those involving non-notifiable mergers and anti-competitive actions against individual companies.
According to Marie Östman, the authority's director general, the goal is to use resources efficiently by carefully prioritizing which issues to delve into from the numerous tips, complaints, and reports received. The updated policy also addresses the authority's approach to monitoring public sales activities, particularly where there are indications of unfair sales practices that could hinder private companies' market operations.
New regulations effective from August 1 have empowered the authority to make decisions on pro-competitive measures targeting individual firms. The prioritization policy outlines that the authority may focus on issues where barriers to effective competition are identified, such as lack of customer information or tacit coordination among companies.
The authority has also engaged the public by allowing feedback on the draft of the prioritization policy before finalizing it, reflecting its commitment to transparency and stakeholder involvement.
