Spanish Competition Authority Fines RTVE for Advertising Violations

The Spanish competition authority, CNMC, has imposed a fine on RTVE for airing advertisements outside permitted hours and without proper identification.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has sanctioned the Corporación de Radio y Televisión Española, S.A. (CRTVE) for violating the General Audiovisual Communication Law during two broadcasts of MasterChef and MasterChef Celebrity on La 1.

The violations occurred on May 5 and November 10, 2024, where communications related to wines were aired outside the allowed time frame and lacked the mandatory message promoting moderate and low-risk consumption.

According to the law, advertisements for alcoholic beverages must be aired only between 20:30 and 5:00 hours. The CNMC found that the commercials were shown in the morning, between 10:42 and 13:55 hours, which is against the regulations.

Additionally, the CNMC noted that promotions for products linked to the MasterChef brand were not clearly identified as advertisements, which could confuse viewers regarding their commercial nature.

CRTVE acknowledged its responsibility and paid the fine of €307,300.80, reduced from the initial proposed amount of €512,168 due to early payment.
