The Netherlands Authority for Consumers and Markets (ACM) has published new guidelines to facilitate the switching of cloud service providers, emphasizing that the process should be quick, straightforward, and without costs for customers. This initiative aims to reduce customer dependency on providers and enhance competition in the cloud market.

With the cloud services market dominated by a few major players, high switching costs and complex contracts often deter customers from changing providers. The guidelines clarify the obligations under the Data Act, which aims to empower users by allowing them to switch easily and use multiple services simultaneously.

ACM's guidelines provide concrete advice for both providers and users, ensuring that customers are aware of their rights and the costs associated with switching. Manon Leijten, a board member of ACM, highlighted that easier switching would stimulate competition on price and quality, benefiting users and enabling smaller providers to compete more effectively.

The guidelines outline four key themes: prohibiting obstacles to switching, ensuring clear commercial obligations, establishing technical requirements for data exchange, and protecting non-personal data from unlawful access. Starting January 12, 2027, providers will no longer be allowed to impose switching charges, further easing the transition for customers.

These regulations apply to all EU member states and extend to cloud service suppliers outside the EU, ensuring a level playing field across the market. Dutch customers can report non-compliance to ACM, which collaborates with other European regulators to address issues involving international providers.
