On October 19, 2026, the Luxembourg administrative court partially confirmed the decision of the competition authority regarding Peter Hennen's practices in the coffee distribution sector. The court upheld a fine of €2.61 million, reduced from the initial €3.08 million, for engaging in anti-competitive agreements with distributors.
The competition authority had originally fined Peter Hennen for colluding with 13 distributors to set minimum resale prices between 2015 and 2020. The court found that the prices communicated by Hennen were not mere recommendations but imposed minimum prices that restricted distributors' freedom to set their own prices.
However, the court determined that there was insufficient evidence to prove collusion with five of the distributors and reduced the duration of the anti-competitive practices for two others. This ruling emphasizes the importance of adhering to competition rules in supplier-distributor relationships.
