Doctolib Fined €4.6 Million for Abuse of Dominance in Medical Booking Sector

The French competition authority has imposed a €4.6 million fine on Doctolib for abusing its dominant position in the online medical appointment booking and remote consultation markets.

The French competition authority, known as the Autorité, has fined Doctolib €4,665,000 for abusing its dominant position in the online medical appointment booking and remote medical consultation sectors. This decision follows a complaint from Cegedim Santé and a dawn raid conducted in 2021.

Doctolib was found to have engaged in two main anticompetitive practices: first, it included exclusivity clauses in its subscription contracts, requiring healthcare professionals to use only its services; second, it acquired its main competitor, MonDocteur, to eliminate competition in the market.

The Autorité imposed a fine of €4,615,000 for the exclusivity and tied selling practices, while a separate fine of €50,000 was levied for the acquisition of MonDocteur, which was not subject to prior merger control due to its size. This marks the first time the Autorité has sanctioned a merger below the notification thresholds for abuse of dominance.

Doctolib's practices were deemed to restrict competition and hinder the development of rival services, ultimately consolidating its market power in both online appointment booking and remote consultation technologies.

In addition to the fines, Doctolib has been ordered to publish a summary of the decision in a medical newspaper, ensuring transparency regarding its anticompetitive behavior.
