The Spanish competition authority, CNMC, has filed a legal challenge against a Balearic decree regulating recreational boat rentals, citing unjustified restrictions on competition.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has initiated a contentious-administrative appeal against several provisions of Decree 44/2025, which governs the rental of recreational boats in the Balearic Islands. This action follows the CNMC's request to the Balearic government to amend or remove problematic articles, which was rejected.

While the CNMC acknowledges the decree's aim to promote responsible and sustainable nautical chartering, it argues that certain articles impose unjustified restrictions that could drive many operators out of the market, hinder new competitors, and diminish the variety and quality of services available to consumers.

Key restrictions challenged by the CNMC include the prohibition of partial boat rentals and the sale of individual spots, which eliminate a common business model without valid safety or environmental justifications. Additionally, the decree discriminates against foreign nautical schools and imposes stringent requirements for foreign vessels, creating barriers to entry that could limit service offerings and increase prices.

The CNMC emphasizes that these measures do not provide additional safety or environmental benefits, which are already ensured by national regulations. The authority is committed to ensuring effective competition for the benefit of consumers and is empowered to contest administrative acts that obstruct market competition.
