French Competition Authority Recommends New Lawyer Office for Supreme Courts

The French competition authority has issued its fifth opinion recommending the establishment of one new lawyer office for the French Administrative Supreme Court and the French Supreme Court by 2027, following a review of the legal profession's growth and economic performance.


The Autorité de la concurrence has released its fifth opinion regarding the freedom of establishment for lawyers at the French Administrative Supreme Court (Conseil d'État) and the French Supreme Court (Cour de cassation) for the years 2025-2027. This recommendation includes the creation of one new office by 2027, which will increase the total number of offices to 72.

This opinion is part of a biannual review mandated by the Act 2015-990, which aims to assess the legal profession's landscape. The analysis considered the current activity of lawyers, the financial health of existing offices, and the anticipated developments in case jurisdiction before the high courts.

Since 2017, the establishment of new offices has proven successful, with the financial performance of these offices remaining strong. The average profit for private lawyers in this sector is approximately €439,000, and the margin rate has remained stable at over 40%. The Autorité believes that increasing the number of offices will not compromise service quality or the viability of existing practices.

However, the Autorité noted two main limitations to the expansion: a decline in cases registered before the Supreme Courts and a limited pool of potential candidates for new offices. Despite these challenges, the Autorité has adopted a cautious approach, recommending only one new office to be created by 2027.

In addition to the new office recommendation, the Autorité has highlighted the need for measures to encourage new professionals to enter the field, particularly experienced legal associates. Recommendations include promoting exceptional access routes to the profession and clarifying conditions for multi-professional companies.
