Mobil Oil Fined $16 Million for Misleading Fuel Claims

The Federal Court has imposed a $16 million penalty on Mobil Oil Australia for misleading consumers about the fuel quality at nine petrol stations in Queensland.

The Federal Court of Australia has ordered Mobil Oil Australia to pay $16 million in penalties for making false or misleading representations regarding the fuel sold at nine petrol stations located in north and central Queensland. This ruling comes as a result of violations of the Australian Consumer Law.

Between August 2020 and July 2024, Mobil admitted to making misleading claims through branding and signage that suggested the fuel sold was 'Mobil Synergy Fuel' with specific additives. However, the fuel at these stations was essentially the same as unadditised fuel available at other non-Mobil retail locations.

The misleading representations included promotional statements such as, “Protect your engine from the first fill” and claims that the additives would enhance engine performance. The Australian Competition and Consumer Commission (ACCC) highlighted that many consumers likely chose these petrol stations under the impression they were purchasing a superior quality of fuel.

ACCC Deputy Chair Mick Keogh emphasized the importance of accurate signage, stating that petrol is a vital good for households, and consumers rely on the information provided by retailers. The Court's decision also mandated that Mobil publish corrective notices, implement a consumer law compliance program, and contribute to the ACCC’s costs.

Mobil cooperated with the ACCC, admitted liability, and agreed to joint submissions regarding the penalties. The affected petrol stations were located in towns and suburbs including Aitkenvale, Barcaldine, and Yeppoon.
