CNMC Proposes Regulatory Improvements for Medical Certificates and Private Electronic Prescriptions
The Spanish competition authority, CNMC, has issued recommendations to improve the regulation of official medical certificates and private electronic prescriptions, aiming for better transparency and efficiency.

The Comisión Nacional de los Mercados y la Competencia (CNMC) has released a report on the draft royal decree that approves the General Statutes of the Organización Médica Colegial (OMC) and the General Council of Official Medical Colleges of Spain. This initiative, requested by the Ministry of Health, aims to unify and update the statutes in line with recent regulations concerning professional services and colleges.
In its recommendations, the CNMC emphasizes the need for the legislator to define which professions should require mandatory registration. It suggests prioritizing less intrusive mechanisms for compliance and respecting professionals' rights regarding their practice.
Regarding official medical certificates, the CNMC advocates for adapting the model to the digital environment, promoting electronic signatures and verification systems. It also recommends prioritizing public verification systems and establishing cost-oriented criteria for any associated fees.
For private electronic prescriptions, the CNMC calls for the establishment of objective, transparent, and non-discriminatory homologation procedures, along with reasonable resolution timelines. It stresses the importance of justifying periodic recertification requirements and ensuring that homologation costs are kept to a minimum.
Additionally, the CNMC highlights the need for safeguards to prevent the exchange of sensitive commercial information and to ensure compliance with competition law.
