The UOKiK's guide titled 'Collusion and Abuse in the Labor Market: Competition Law and Employment Issues' was released in July 2024 and aims to educate both employers and employees about practices that may violate competition law.
It emphasizes that many individuals are unaware that agreements regarding employees can breach competition rules, potentially leading to penalties from UOKiK. The guide is particularly important for HR managers, as it explains how they can also violate the law and face financial consequences.
The publication has been promoted through UOKiK's social media channels and in collaboration with the National Labor Inspectorate and the Ministry of Family, Labor, and Social Policy. It has been nominated for an award by experts in competition law, including lawyers, economists, and academics.
Voting for the best publication will take place until March 21 on the Concurrences portal. The guide outlines prohibited practices such as wage-fixing, where competitors agree on salary levels, and no-poaching agreements, where companies agree not to recruit each other's employees.
Such collusive practices can lead to significant financial penalties, including fines of up to 10% of a company's turnover and up to 2 million PLN for managers directly involved in the illegal agreements.
