Polish Competition Authority Investigates Aggressive Practices by Developers

The Polish competition authority, UOKiK, has raised allegations against developers Idea-Inwest, M2R, and Jelbud for engaging in aggressive market practices that may have pressured consumers into unfavorable agreements.
Complaints from consumers regarding the developers' actions after signing contracts prompted UOKiK to conduct investigations. Evidence from contracts, consumer signals, and correspondence from the developers led to the initiation of proceedings against these companies.
Developers Idea-Inwest and M2R reportedly informed consumers that signing an annex to their contracts, which increased the previously agreed price, was a condition for transferring ownership of their apartments. Consumers were warned that failure to pay the additional amount could lead to legal action and jeopardize their investments.
UOKiK believes these communications may have created a sense of real threat among consumers regarding their ownership rights, potentially limiting their freedom to choose whether to accept the price increase.
Meanwhile, Jelbud allegedly pressured consumers to waive claims for penalties due to delays in transferring ownership, suggesting that financial difficulties could lead to insolvency if penalties were pursued. This could have unduly influenced consumers to forgo their rights.
UOKiK's investigations will determine whether these developers employed prohibited aggressive market practices that significantly restricted consumer decision-making. The proceedings could result in fines of up to 10% of the companies' annual turnover.
