The Polish competition authority, UOKiK, has issued a decision against Procam for exploiting its contractual advantage over farmers. The company required farmers to deliver all contracted agricultural products, even in cases of adverse weather conditions such as droughts, frosts, or hail, which were beyond their control.

UOKiK's President, Tomasz Chróstny, emphasized that farmers should not bear the entire risk of such uncontrollable events. The contracts stipulated that farmers had only two days to notify Procam of force majeure events, which was deemed insufficient for them to take necessary actions to mitigate damages.

Procam's contracts defined force majeure events but excluded common weather-related occurrences, leaving farmers vulnerable to penalties for non-delivery. Following the investigation, Procam cooperated with UOKiK and agreed to pay a fine of over one million zlotys, amounting to 1,006,258.78 PLN, and will implement new contracts starting June 2026.

This decision aligns with UOKiK's ongoing efforts to combat unfair contractual practices, as seen in previous cases involving other companies. The authority is also collaborating with agricultural organizations to monitor the impact of adverse weather on farmers and encourages them to report any unfair practices they encounter.
