Estonian Competition Authority Acts Against Unfair Practices in Food Supplement Sector

The Estonian Competition Authority has issued injunctions to three wholesalers of food supplements, mandating them to cease unfair commercial practices that violate payment regulations.

The Estonian Competition Authority has taken action against Allium UPI OÜ, Magnum Medical OÜ, and Tamro Eesti OÜ for employing unfair commercial practices in their dealings with food supplement suppliers.

During a supervisory procedure, the Authority discovered that these wholesalers imposed contractual conditions that hindered suppliers from adhering to the legally mandated 30-day payment period. This regulation is designed to ensure that agricultural and food producers receive timely payments, which are crucial for maintaining their economic stability.

Furthermore, the wholesalers' contracts included clauses that required suppliers to reimburse the purchase price for expired or near-expiration goods and to cover the costs associated with their destruction. The Competition Authority deemed these indemnification agreements as prohibited practices, as they do not align with the provisions of the Act on Combating Unfair Trading Practices in the Agricultural and Food Supply Chain.

The affected wholesalers are required to revise their contract terms to comply with the law. The Competition Authority will continue to monitor unfair trading practices, particularly focusing on contracts between retailers and food producers this year.
