The European Commission has launched a public consultation on draft Guidelines concerning exclusionary abuses of dominance under Article 102 of the TFEU. This includes behaviors such as predatory pricing, margin squeeze, exclusive dealing, and refusal to supply that can harm competition.
The Guidelines aim to clarify the application of EU competition law in cases of exclusionary abuses, providing guidance on key issues like consumer welfare, dominance assessment, abuse determination, and evidence requirements for showing exclusionary effects.
Interested parties have until October 31, 2024, to submit feedback on the draft Guidelines. The Commission plans to finalize the Guidelines based on the received comments by 2025, aiming to enhance legal certainty for businesses, consumers, and competition authorities.
