02.02.2025 | Luxembourg competition authority
On January 30 and 31, agents from the Luxembourg competition authority, supported by the judicial police and under the supervision of an investigating judge, carried out unannounced inspections at several companies suspected of engaging in anti-competitive practices within the insurance sector.
These inspections are a preliminary step in the investigation process concerning anti-competitive practices. It is important to note that these actions do not imply that the companies are guilty of anti-competitive behavior, nor do they prejudge the outcome of the investigation, which will be conducted in accordance with the rights of the defense.
The authority emphasizes the presumption of innocence and will not disclose the identities of the companies involved in the inspections or the specific practices being investigated.
This press release is issued at the request of the investigating advisor to inform companies that were not inspected and to ensure equal access to the leniency program.
The leniency program allows a company that has participated in an anti-competitive agreement to receive total immunity or a reduction in fines if it provides evidence of the agreement and fully cooperates with the authority.
Companies with concerns about their current or past behavior are encouraged to act quickly and seek the benefits of the leniency program. For an informal and confidential initial discussion, they can contact Ms. Charline Di Pelino.
This press release is based on Article 9, paragraph 2, of the amended law of November 30, 2022, regarding competition, which allows the authority to publish brief information about its actions in the interest of the public while respecting the presumption of innocence of the companies involved.
