The President of the Bundeskartellamt, Andreas Mundt, presented the authority’s Annual Report for 2024/25, emphasizing the critical role of competition in fostering innovation and economic growth. He noted that fair competition leads to better quality and prices for consumers, which are essential for a robust economy.
The report outlines the authority's actions in the digital economy, particularly against major tech companies. The Bundeskartellamt has utilized the Digital Markets Act and Section 19a of the German Competition Act to ensure that the market remains open to new competitors. Notable cases included assessments of Apple’s App Tracking Transparency Framework and Amazon’s price control mechanisms, which have resulted in improved competition conditions.
In terms of cartel prosecution, the Bundeskartellamt imposed fines totaling around 26 million euros on several companies across various sectors, including telecommunications and construction. The authority reported an increase in the number of concluded proceedings and dawn raids, indicating a proactive approach to enforcing competition laws.
The report also covers merger control, with the Bundeskartellamt reviewing approximately 870 merger projects in 2024. Several mergers were closely examined, with some being prohibited due to competition concerns. The authority reaffirmed its commitment to maintaining effective competition while allowing for the emergence of national champions.
A sector inquiry into the mineral oil industry revealed significant competition issues, particularly regarding pricing transparency and the influence of a few providers on price assessments. The Bundeskartellamt is considering further measures to address these challenges.
Additionally, the authority is investigating district heating providers and energy price relief measures, aiming to ensure compliance with legal standards and protect consumers from potential abuses. The report also highlights the establishment of the Competition Register, which facilitates better monitoring of companies involved in public procurement.
