First Consumer Organization Registered for Group Actions in Poland

The LexCultura Foundation has become the first consumer organization registered to initiate group actions in Poland, allowing it to represent consumers in court against unfair business practices.

The Polish competition authority has officially registered the LexCultura Foundation, granting it the right to file group actions on behalf of consumers. This marks a significant development in consumer protection, as it is the first organization to achieve this status since the introduction of new legal provisions in 2024.

The new legal framework, established under the European Parliament and Council Directive 2020/1828, aims to enhance consumer protection by allowing authorized organizations to represent consumers in court against unlawful business practices. Examples of such practices include misleading advertisements and unjustified fee increases.

To qualify for registration, organizations must meet specific criteria, including being a legal entity focused on consumer protection for at least 12 months prior to application. They must also demonstrate independence and avoid conflicts of interest.

With this registration, LexCultura can now demand the cessation of practices that violate consumer interests and seek specific remedies for affected consumers, such as refunds or contract cancellations. The Polish competition authority encourages other organizations to apply for similar registrations to strengthen consumer representation in group actions.
