The Polish competition authority, known as UOKiK, has initiated an inquiry into the baggage policies of low-cost airlines Ryanair and Wizz Air. This decision comes after receiving multiple complaints from passengers regarding the enforcement of carry-on baggage rules.
Passengers have reported a recurring issue where they are asked to place their backpacks into a metal frame, referred to as a 'sizer', to check if their baggage meets the allowed dimensions. Many complaints suggest that this frame does not accurately reflect the permitted size for carry-on luggage. Previously, these backpacks qualified as free carry-on baggage, but now airlines claim they do not meet the requirements, leading to additional charges that can reach several hundred zlotys.
Travelers have expressed concerns about the hurried nature of the measurement process, which does not allow for a second check or the use of an alternative measuring device. Furthermore, passengers who refuse to pay the arbitrarily imposed fees, which can only be paid by card, are reportedly denied boarding.
In response to these consumer signals, UOKiK is examining the contractual terms related to carry-on baggage transport, the information provided to consumers when purchasing tickets, the baggage measurement procedures, the rules for charging fees, and the consequences for consumers who do not pay these fees. The authority is also looking into how complaints regarding what consumers perceive as unjust fees are handled.
According to the European Court of Justice's rulings, carry-on baggage, as long as it falls within reasonable weight and size limits and does not violate safety regulations, should be considered an integral part of the transport service without incurring additional charges. UOKiK aims to determine whether low-cost airlines adhere to this principle in practice.
If the investigation confirms that the policies regarding carry-on baggage and the imposition of excess baggage fees violate consumer rights, UOKiK may initiate proceedings to declare certain contractual provisions as unlawful or to address practices that infringe upon collective consumer interests.
