The Dutch competition authority, ACM, warns that consumers face challenges in selecting energy contracts due to unclear resellers and early-termination fees. The authority is investigating these issues further.


The Netherlands Authority for Consumers and Markets (ACM) has raised concerns about the difficulties households encounter when choosing new energy contracts. Key issues include uncertainty regarding resellers, the lack of clarity about early-termination fees, and the overall complexity of energy contracts.

ACM advises consumers to avoid agreeing to energy contracts during unsolicited phone calls and to refrain from signing authorizations without understanding the implications. When dealing with resellers, consumers should ensure they know which energy supplier the reseller represents and the specific terms of the contract.

Resellers, who are businesses selling contracts on behalf of energy suppliers, must clearly identify themselves and the licensed suppliers they represent. ACM's investigations have shown that many resellers fail to provide this essential information, leaving consumers unaware of the actual supplier behind their contracts.

Additionally, some resellers operate with authorizations that allow them to sign contracts on behalf of consumers without further consultation. This can lead to confusion about which licensed supplier the consumer is actually contracting with. Consumers have the right to revoke these authorizations at any time, allowing them to choose their preferred energy supplier.

ACM has also investigated early-termination fees associated with fixed energy contracts. The findings indicate that consumers often do not understand how these fees are calculated, making it difficult for them to make informed decisions about terminating contracts early. The authority has noted instances where incorrect information about these fees is provided during sales calls, further complicating the decision-making process for consumers.

To address these issues, ACM is continuing its investigation into early-termination fees and will take action against energy suppliers that fail to comply with regulations. The authority emphasizes the importance of transparency and accurate information for consumers when selecting energy contracts.
