ACM Cracks Down on Deceptive Marketing by Commercial Debt Counselors
The Netherlands Authority for Consumers and Markets (ACM) has taken action against two businesses for misleading consumers about the costs of commercial debt counseling services, potentially leading them to believe the services were free municipal offerings.

The ACM intervened against two businesses that were attracting customers for commercial debt counselors without clearly disclosing that the services were not free municipal offerings. This lack of transparency could mislead consumers into incurring unexpected costs.
Following ACM's actions, one business took down its websites, while the other clarified that its services were not free. The regulator emphasized the importance of businesses targeting vulnerable individuals, such as those with debts, to provide clear and accurate information about costs.
ACM received reports in June about websites of commercial debt counselors that appeared to be affiliated with municipalities but did not disclose the costs of their services. Consumers filling out contact forms on these websites were directed to commercial providers instead of municipal services, leading to potential confusion and unexpected charges.
ACM had previously reminded commercial debt counselors of consumer protection rules, including the obligation to clearly disclose their identity, services offered, and associated costs. The regulator continues to monitor websites for compliance with these rules.
